Return of Dog
Guardian shall retain possession of the dog and shall provide physical care to and supervision of the dog subject to the terms and conditions of this agreement. Guardian may terminate agreement in writing subject to the foregoing provisions. Upon termination, The Guardian must return Guardian Home Dog to Breeder within three days. Any liquidated damages in accordance with this agreement are due to Breeder immediately upon providing notice.

The Guardian is responsible for seeking prompt and appropriate veterinary care in the event of injury or illness of the dog. If choices need to be made regarding type of treatment, these choices must be presented to, and made by, the Breeder unless emergency treatment is required. Breeder shall pay for all veterinary expenses as related to breed‐related costs. The Buyer agrees to sign the necessary papers to return the Breeder as sole owner of the dog in the event the dog is returned. After months and for the life of the dog, the Buyer may return the dog to the Breeder at any time and for any reason. The Buyer agrees that it is the Buyer’s responsibility to accept the dog as described.

O Take possession of a female dog from Guardian approximately 2-5 days prior to whelping date and provide care and supervision of the female dog until completion of weaning of puppies born to the female dog. Ownership and all rights and interest to the Dog shall remain with the Breeder until such time as Breeder shall, by bill of sale or other written evidence of transfer, assign and transfer ownership of the Dog to Guardian. Likewise, any puppies born to Dog shall be the sole and separate property of Breeder and Guardian shall have no ownership or interest of possession rights to any such puppy. Guardian intentionally causes injury to the dog that prevents the dog from breeding or intentionally or out of negligence causes death of the dog. There are mixed opinions regarding the need for a contract when selling or placing a dog. Many breeders supply a contract for any relocated dog for the sole purpose of safeguarding his health and welfare.
Guardian may not choose or allow any elective veterinary procedures or treatment without consulting Breeder. Guardian must notify Breeder of scheduled vacations or other absences from the area which might occur during the time the Dog would be used as a stud. Both girls are comfortable around other dogs and cats that are comfortable around dogs. Guardian and family members agree to attend obedience classes with Dog, at their earliest convenience, and continue socialization as discussed.
Breeder will provide health certification copies of OFA hip/elbow and CERF testing for Guardian home records.
Most breeder contracts require pet-quality dogs to be spayed or neutered. But as veterinary attitudes and research evolve, the age at which surgical sterilization is performed can vary markedly. Some breeders require that owners wait until the dog has stopped maturing and the growth plates close – a year for most breeds, 18 months for larger dogs – which some studies have shown lowers the risk of bone cancer.
I am so sorry that things went this way but the contract should always be honored; it’s a legal document.
